  • has undergone neither repair nor attempted repair subsequent to receipt
  • Has no problem that can be found on both new and used smartphones if it concerns what is a manufacturer’s defect to begin with.
  • has no problem due to an operating system update or installation of an operating system different from the one installed at the time of delivery
